Considering Lemmon Law - anyone else ever had to file?

Q: i am considering filing a lemmon law case for my 2003 dodge ram. it only has 5000 miles on it and has had the rotors replaced warped been re-alligned twice had the ignition switch replaced and the wheels rebalanced. i know that at this point i dont really know if i have much of a case since the lemmon law states that your claim has to be based on the same problem being uncorrectable by the dealership...or have an unreasonable number of defects within a certain timeframe. to me this number of defects is unreasonable given the duration of time that i have owned the truck 3 months. has anyone else ever filed lemmon law and won what do you win ....a replacement ram the sales price that you paid for your vehicle at this point id like to just take the truck back and go elsewhere. i love the truck but cant stand things going wrong with it all the time. .

i am considering filing a lemmon law case for my 2003 dodge ram. it only has 5000 miles on it and has had the rotors replaced warped been re-alligned twice had the ignition switch replaced and the wheels rebalanced. i know that at this point i dont really know if i have much of a case since the lemmon law states that your claim has to be based on the same problem being uncorrectable by the dealership...or have an unreasonable number of defects within a certain timeframe. to me this number of defects is unreasonable given the duration of time that i have owned the truck 3 months. has anyone else ever filed lemmon law and won what do you win ....a replacement ram the sales price that you paid for your vehicle at this point id like to just take the truck back and go elsewhere. i love the truck but cant stand things going wrong with it all the time. which state in texas your problems dont have to be a major defect. it can be anything that takes away from the market value of the vehicle. you do have to give the manufacturer a reasonable number of chances to fix the problem. which equates to 4 times according to the information ive found. here is the law for texas section 6.0.7 c c if the manufacturer converter or distributor is unable to conform the motor vehicle to an applicable express warranty by repairing or correcting any defect or condition which creates a serious safety hazard or substantially impairs the use or market value of the motor vehicle after a reasonable number of attempts the manufacturer converter or distributor shall 1 replace the motor vehicle with a comparable motor vehicle; or 2 accept return of the vehicle from the owner and refund to the owner the full purchase price less a reasonable allowance for the owners use of the vehicle and any other allowances or refunds payable to the owner. in this section impairment of market value means a substantial loss in market value caused by a defect specific to the vehicle. in addition to replacing the vehicle or refunding the purchase price the manufacturer converter or distributor shall reimburse the owner for reasonable incidental costs resulting from loss of use of the motor vehicle because of the nonconformity or defect. as necessary to promote the public interest the commission by rule shall define the incidental costs that are eligible for reimbursement shall specify other requirements necessary to determine an eligible cost and may set a maximum amount that is eligible for reimbursement either by type of eligible cost or a total for all costs. refunds shall be made to the owner and lienholder if any as their interests may appear. a reasonable allowance for use shall be that amount directly attributable to use of the motor vehicle when the vehicle is not out of service for repair. an order to refund or to replace may not be issued by the executive director against a manufacturer converter or distributor unless the manufacturer converter or distributor has been mailed prior written notification of the alleged nonconformity or defect from or on behalf of the owner and has been given an opportunity to cure the alleged defect or nonconformity. in any hearing before the executive director under this section a manufacturer converter or distributor may plead and prove as an affirmative defense to the remedies provided hereunder that 1 the nonconformity is the result of abuse neglect or unauthorized modifications or alterations of the motor vehicle; or 2 the nonconformity does not substantially impair the use or market value of the motor vehicle. in this section serious safety hazard means a life-threatening malfunction or nonconformity that substantially impedes a persons ability to control or operate a motor vehicle for ordinary use or intended purposes or that creates a substantial risk of fire or explosion. i had to pursue this with toyota. i have had good luck with the dodge so far. i suggest you give the truck a bit more of a chance. in either case good luck! craig c. 2002 ram 1500 qc 4x4 5.9l .
